HARMONIZATION OF GAS DISTRIBUTORS PRICES BY YEAR-END ...

Belgrade, October 21, 2008 The new price regulation system brought into agreement with the Energy Law shall apply to customers and users of Srbijagas transport and distribution system as of October 15, 2008. The Decision of Srbijagas Management Board defining natural gas prices for Srbijagas tariff customers and charges of access to and use of natural gas transport and distribution system operated by Srbijagas was approved by the Serbian Government based on the Agencys Opinion.

Coming into effect of above mentioned Srbijagas prices which include wholesale prices applying to all other distribution companies Srbijagas supplies natural gas to enables harmonization of prices of all distribution companies with the Energy Law.

Supported by the Ministry of Mining and Energy, the Agency requested all licensed gas distributors to submit their proposals for tariff customer prices and use of distribution network charges a.s.a.p. for the purpose of bringing price setting into agreement with the Energy Law until the year-end. In this way setting of prices, paid by their customers, will require approval of the Serbian Government based on a prior Opinion of the Agency. As in the case of Srbijagas, prices will be set according to justified costs of each distribution company. Distribution margins, which now cease to apply, varied to a high degree (even up to 40%) and distribution network losses amounted to over 20%. The new tariff system is expected to reduce these price differences. The price level will also depend on the person who invested in the network in case of consumer investments or donations the prices will be lower.

The price setting for distribution company customers was and still is in the domain of the local self-government. In line with the Energy Law, the Agency shall exercise its powers when these companies start to apply tariff systems.

Suboticagas has just submitted to the Agency its price proposal. Novi Sad Gas is expected to do the same soon.

At present there are 37 distribution companies in Serbia, including the distribution division of Srbijagas, of which 29 companies have licenses to carry out this activity. The remaining 8 companies filed applications for licensing, but didnt quality.

The Agency emphasizes that the Energy Law clearly sets out that an energy entity may start an energy activity on the basis of a license issued by the Agency. For entities already carrying out an energy activity at the time when the Law came into effect, a time frame was determined within which they had to acquire a license under conditions laid down in the Law. It is important to highlight that natural gas distribution activities are activities of general interest and they can only be carried out by companies established by the Government and companies entrusted by the Government to carry out these activities.

The competent inspector exercises the control function, that is, he has the right to verify whether entities carrying out energy activities meet the relevant requirements. In such legal framework the Agency shall indicate (orally and in writing) that particular entities carry out activities without a license (to the Ministry, Provincial Secretariat and directly to relevant energy entities which filed licensing requests and failed to correct omissions even after several months had passed).

Since a licensing application shall be resolved at the request of the energy entity in line with the General Administrative Procedure and not according to Agencys official capacity, and due to the fact that the Agency performs these duties as activities entrusted to it (the body of second instance is the Ministry), it is clear that the Agency cannot institute measures nor decide without the request of the interested entity. The license is revoked in case the company fails to meet the relevant requirements.
